TABEX Customer Terms & Agreement

What TABEX Is

TABEX (Tabogon Express) is a cash-on-delivery (COD) food ordering and delivery platform for Tabogon, Cebu. By using the customer app you agree to these Terms & Agreement.

Nature of the Relationship

TABEX is a digital platform that connects you with independent partner kitchens and freelance riders. Partner kitchens prepare and sell the food; riders deliver it. TABEX provides the ordering technology and matching — it is not the restaurant, not the seller of the food, and not your employer of the rider. Food quality, allergens, preparation, and kitchen delays are the kitchen’s responsibility. Safe riding and on-time delivery conduct are the rider’s responsibility as an independent contractor.

Account and Verification

Customers must be at least 18 years old. You agree to keep your profile truthful — name, delivery address and landmark context, birthdate, cellphone, and profile selfie — for COD safety and identity checks. You may sign in with cellphone, Google, or Facebook where offered. You must provide a working Philippine cellphone so kitchens and riders can reach you about the order. TABEX may restrict ordering until your profile is complete.

Orders, Prices, and Cash on Delivery

Orders are paid only in cash to the rider upon delivery (COD). Prices shown in the app include food (with platform commission built into listed food prices where applicable), delivery fee, and any separate platform fee. You are responsible for having the exact COD total ready when the rider arrives. COD orders must stay below your personal maximum shown at checkout (base under ₱1,000; loyal customers with recent delivered orders may see a higher limit). Do not ask riders or kitchens to change prices outside the app.

Delivery Location, GPS, and Service Area

You must set an accurate delivery pin and a clear landmark. Wrong or incomplete details may delay or cancel delivery. Checkout uses your GPS (or a profile pin you confirm) to check TABEX service area and calculate delivery distance and fees. While an order is active, the assigned rider may share live GPS with you for tracking, and your drop-off pin and contact details are shared with the assigned kitchen and rider so they can fulfill the order.

How Fulfillment Works

After you place an order, TABEX looks for a nearby rider (commonly about 5 minutes). Once a rider accepts, the kitchen must confirm (commonly about 15 minutes, then about 25 more minutes if it still has not confirmed). The kitchen prepares the food; the rider picks up and delivers to your landmark. You can track progress in the app. Special notes, size choices, and included drink choices (when offered) must match what you selected; report mismatches promptly to TABEX ops.

Cancellations, Timeouts, and Problems

You may cancel only while the order is still waiting for a rider (PENDING). After a rider accepts, cancellation through the customer app is no longer available. Unaccepted rider or kitchen steps may auto-cancel after the acceptance timeouts. Kitchens may decline when busy or closed. If food quality, missing items, late delivery, or rider issues occur, report them promptly through the app or TABEX ops. Because payment is COD at the door, TABEX does not operate an automatic refund or chargeback flow; remedies are handled case-by-case by TABEX ops.

Food, Allergens, and Liability

Menus and photos are provided by partner kitchens. You are responsible for checking descriptions and communicating allergies or restrictions (including via special note where available). To the fullest extent allowed by law, TABEX is not liable for foodborne illness, allergen reactions, preparation errors, incorrect items packed by the kitchen, or taste/quality disputes. Those claims are between you and the kitchen (with ops support as needed). TABEX is also not liable for traffic delays or accidents involving independent riders beyond what the law requires of a technology platform.

Your Information

We use your account, order, and location information to run COD delivery as described in the TABEX Privacy Policy. For each order, your name, cellphone, landmark, and delivery pin may be shown to the assigned kitchen and rider. Do not use the app to harass kitchens or riders. Reviews you submit may appear publicly on the platform.

Conduct, Fraud, and Enforcement

Abuse, threats, harassment, fraud (including fake orders, payment tricks, refusing COD after the rider arrives without a valid reason, or false reports), or other misuse of TABEX may lead to account restriction, temporary suspension, or permanent blocking. Repeated serious reports from riders or kitchens (including verified strike reports) may result in automatic blocking. Serious or repeated violations may also be referred for legal action. You agree to treat riders and kitchen partners with respect.

Acceptance

Tapping Accept means you have read and agree to these Terms & Agreement. Using TABEX to browse or place orders after acceptance confirms that agreement. TABEX may update terms over time; when asked to re-confirm, you must accept the revised terms before continuing to order.
