Partner Role
As a TABEX merchant/partner, you use the partner console to receive, prepare, and hand off cash-on-delivery (COD) food orders for customers in Tabogon, Cebu. These Terms & Agreement govern your kitchen’s use of the platform and bind the store owner who accepts them on behalf of the kitchen.
Nature of the Relationship
TABEX is a digital platform that connects customers, partner kitchens, and freelance riders for COD orders in Tabogon, Cebu. You operate as an independent business (not as an employee, agent, franchisee, or joint-venture partner of TABEX). You prepare and sell your own food; TABEX does not cook, own, or take title to your menu items. TABEX provides technology, listing, and logistics matching — it is not the seller of food to the customer. You remain solely responsible for your kitchen’s operations, staff, pricing, permits, taxes, and food quality.
Onboarding and Listing Privilege
Partner accounts are created and approved by TABEX ops. You must complete onboarding (menu, hours, profile with an accurate kitchen GPS pin) and submit for review before you may accept live orders. Listing on TABEX is a privilege, not a right. Ops may approve, reject, deactivate, or remove a kitchen. You may only receive new orders when your kitchen is approved, active, within opening hours, and set to accepting orders. TABEX may pause new orders during platform maintenance or for safety/ops reasons.
Orders, Timeouts, and Kitchen Readiness
You must keep store status (open/busy), opening hours, menu availability, prices, prep time, and kitchen location accurate. When a rider has accepted a job, your kitchen must accept or decline promptly. Unaccepted orders may auto-cancel after the merchant acceptance timeout shown in ops settings (commonly about 15 minutes after rider accept, then about 25 more minutes). When you accept an order, you commit to prepare it for rider pickup within your stated prep window, then mark it ready for pickup. If you reject after a rider is assigned, the order becomes unavailable to the customer. Repeated no-shows, late accepts, or cancellations after accept may lead to deactivation.
Cash on Delivery and Settlement
TABEX orders are cash on delivery. The customer pays the full COD total (food, delivery fee, and any platform fee) to the rider at drop-off. At kitchen pickup, the rider pays you the merchant payout shown in the partner console — typically the food subtotal minus the TABEX commission. That cash at pickup is your settlement for the order. TABEX does not owe you a separate bank or GCash remittance for standard COD food orders unless ops arranges something different in writing. Do not invent extra fees or alter amounts outside the app.
Commission and Menu Pricing
TABEX charges a platform commission on food sales at the live rate configured by ops (platform settings). Customer-facing menu prices include that commission on top of your dine-in price so your kitchen still receives the dine-in amount after commission, subject to the settlement rules above. Ops may change the commission rate or related fees; material changes will be communicated, and continued use after you re-accept updated terms (when asked) means you agree. Any temporary soft-open or promotional zero-commission period is an ops policy only and does not create a permanent right to zero commission.
Food Safety, Permits, and Listings
You are solely responsible for food safety, hygiene, allergens, accurate descriptions, and compliance with applicable local rules and any permits your kitchen requires. Menu photos and descriptions must fairly represent what you sell. You must not list illegal, expired, unsafe, or mislabeled goods. TABEX may remove listings or deactivate kitchens for safety or misrepresentation concerns, but TABEX is not your food-safety inspector and is not liable for illness, allergy reactions, or product defects arising from your food.
Photos, Content, and Intellectual Property
When you upload photos, names, or descriptions, you confirm you have the right to use them and grant TABEX a non-exclusive license to display them in the customer app, marketing surfaces, and related ops tools. TABEX may remove content that is misleading, infringing, offensive, or unsafe.
Kitchen Staff
If you create kitchen staff logins, you authorize those staff to perform the actions their role allows (such as accepting or rejecting orders and toggling item availability). You are responsible for their conduct on the console. Disable staff accounts when someone leaves. Staff cannot accept these Partner Terms — only the kitchen owner can; staff must wait until the owner has accepted.
Customer and Rider Information
To fulfill orders you may receive customer name, cellphone, delivery landmark, and order notes, and you may see rider contact details for pickup coordination. Use this information only to prepare and hand off that order. Do not sell, spam, harass, or use customer or rider data for unrelated marketing. Keep it confidential and stop using it when no longer needed for the order, except where law requires retention.
Reviews, Home Ads, and Ops Notices
Customers may leave public ratings and comments about your kitchen. TABEX may display them and may remove abusive content. Featured or home-ad placement, when offered, is promotional visibility configured by ops — it is not a warranty of sales or an endorsement of food safety. When TABEX ops publishes partner notices in the console, the owner should read and acknowledge them; important operational rules may be communicated that way.
Account Security and Taxes
Keep owner and staff logins (cellphone, username, password) confidential. Activity under your kitchen’s accounts is treated as authorized by your business. You are responsible for your own business registration, receipts, and tax obligations arising from sales made through TABEX.
Conduct and Deactivation
Treat customers and riders with respect. Fraud, harassment, unsafe food practices, fake menus, misuse of customer data, or abuse of the console may result in immediate deactivation and possible legal action. TABEX ops may suspend, deactivate, reject, or remove a kitchen to protect customers, riders, or the platform. Deactivated approved kitchens may lose partner-console access until ops restores them.
Platform Liability
To the fullest extent allowed by law, TABEX is not liable for foodborne illness, allergen reactions, preparation errors, incorrect orders, kitchen delays, disputes over cash handed at pickup, or losses caused by your staff or suppliers. TABEX’s role is limited to providing the ordering and matching platform. Your remedies against TABEX for platform issues are limited to support from TABEX ops; nothing in these terms creates employment, partnership, or insurance coverage by TABEX for your kitchen.
Acceptance
Tapping Accept means you have read and agree to these Terms & Agreement on behalf of your kitchen. Using the partner console after acceptance confirms that agreement. TABEX may update partner terms; when asked to re-confirm, continued use requires the owner to accept the revised terms before the kitchen continues.
